These Terms of Service (or “Terms”) govern your access and use of Wakala Forum, except where we expressly state that separate terms (and not these) apply, and provide information about the Wakala Forum Service (the “Service”), outlined below. The Wakala Solutions Terms of Service do not apply to this Service.
Wakala Forum is one of the Wakala Solutions Products, provided to you by Lastborn Company Limited. These Terms of Use therefore constitute an agreement between you and Lastborn Company Limited. If you do not agree to these Terms, then do not access or use Wakala Forum.
1. Wakala Forum As A Service
We agree to provide you with the Wakala Forum Service. The Service includes all of the Wakala Forum products, features, applications, services, technologies, and software that we provide to advance Wakala Forums's mission: To bring you closer to other mobile money agents and information you need. The Service is made up of the following aspects:
Opportunity to create and communicate: People have diverse interests, and at Wakala Forum, we recognize that everyone values different experiences. That’s why we provide features designed to help you connect, create, and communicate with others both on and off the platform.
Our goal is to strengthen your relationships through meaningful interactions and shared experiences that matter to you. To achieve this, we develop intelligent systems that learn what you and others care about, helping you discover relevant content, communities, and people who share your interests. We personalize your experience by recommending posts, discussions, offers, and accounts you may find valuable, ensuring that Wakala Forum remains a space where you can engage with content that truly resonates with you. By analyzing how you and others interact on and beyond Wakala Forum, we continuously enhance your experience, making it easier to create, find, and share meaningful connections.
Creating a Supportive, Inclusive, and Secure Community: We are committed to building a positive, inclusive, and safe environment for all members of the Wakala Forum community. To achieve this, we develop and implement tools, resources, and support systems that enhance user experiences while ensuring inclusivity. Our dedicated teams and advanced systems actively monitor and combat abuse, policy violations, and harmful or deceptive behavior to maintain the integrity of our platform.
To keep Wakala Forum secure, we utilize all available information—including user data—to detect and prevent potential risks, threats, and misuse. In cases where safety is at risk, we may share information about misuse or harmful content with other Wakala Solutions services or law enforcement agencies as necessary. By leveraging the information we have—including details about your interactions (as outlined in our Privacy Policy)—we work to provide smarter, safer, and more secure services across all Wakala Solutions products. Our platform is designed to allow seamless interaction between the Wakala Solutions services you use, ensuring a consistent and connected experience tailored to your preferences and choices.
Guaranteeing seamless access to our platform: To provide Wakala Forum in supported regions, we rely on a global infrastructure to store, transfer, and process data across our systems, including locations outside your country of residence. This worldwide network is essential for ensuring the availability, security, and efficiency of our services. Some of this infrastructure may be owned and operated by third-party providers rather than LastBorn Company Limited. Connecting you with brands, products, and services: We may use data from Wakala Forum, other Wakala Solutions Products, and trusted third-party partners to deliver ads, offers, and sponsored content that we believe will be relevant and meaningful to you. Our goal is to ensure that this content seamlessly integrates with your overall experience on Wakala Forum, making it just as relevant and personalized as everything else you encounter.
Innovation and Research: We leverage the information we collect to analyze and improve our service, while also collaborating with partners on research initiatives aimed at enhancing our platform and supporting the well-being of our community.
2. How Wakala Forum Is Funded
By using Wakala Forum and the services covered by these Terms, you acknowledge that instead of a subscription fee, we may display ads funded by businesses and organizations on and off Wakala Solutions Products. We use your personal data, including details about your activity and interests, to deliver ads that are more relevant and tailored to you.
We display relevant and useful ads without revealing your identity to advertisers. Your personal data is never sold. Instead, we allow advertisers to share their business objectives and the type of audience they wish to target. Based on this information, we show their ads to individuals who may be interested.
We also offer advertisers detailed reports on the performance of their ads to help them understand how users are engaging with their content on and off Wakala Forum. For instance, we provide aggregate demographic and interest data to help advertisers better understand their target audience. However, we never share personally identifiable information (such as your name or phone number) unless you explicitly grant us permission to do so.
You may come across branded content on Wakala Forum posted by account holders who promote products or services through commercial partnerships with the businesses featured in their content.
3. Our Privacy Policy
To provide our service, we collect and use your information. Our Privacy Policy outlines how we collect, use, and share data across all Wakala Solutions Products, as well as the various ways you can manage your information, including through the Wakala Forum Privacy and Security Settings. By using Wakala Forum, you agree to comply with our Privacy Policy.
4. Your Commitments
In exchange for our commitment to providing the service, we ask that you make the following commitments to us.
4.1 Eligibility to Use Wakala Forum: We strive to make our service as open and inclusive as possible, while ensuring it remains safe, secure, and compliant with the law. To be part of the Wakala Forum community, we ask that you adhere to certain guidelines and restrictions.
- You must be at least 13 years old, or the minimum legal age required in your country, to use Wakala Forum.
- You must not be restricted by any applicable laws from receiving any part of our service or engaging in payment-related services if you are listed on any restricted or denied party list.
- Your account must not have been previously disabled due to a violation of the law or any of our policies.
- You must not be a convicted sex offender.
4.2 Prohibited Use of Wakala Forum: To maintain a safe and inclusive service for our diverse community, it is essential that everyone follows the rules and does their part.
- You are prohibited from impersonating others or providing false information. While you are not required to disclose your identity on Wakala Forum, you must provide accurate and up-to-date information, including during registration, which may involve sharing personal data. Additionally, you may not impersonate any individual, entity, or organization, nor create an account on behalf of someone else without their explicit consent.
- You must not engage in any unlawful, misleading, or fraudulent activities, or use the platform for any illegal or unauthorized purposes.
- You must not violate, or assist others in violating, these Terms or our policies, including the Community Standards, Wakala Solutions Terms, and Music Guidelines. If you post branded content, you are required to adhere to the Branded Content Policies. For information on how to report misconduct or inappropriate content, please refer to our Help Center.
- You must not engage in any activity that interferes with or disrupts the proper functioning of the service. This includes abusing any reporting, dispute, or appeals process, such as making fraudulent or baseless reports or appeals.
- You must not attempt to create accounts, access, or collect information through unauthorized methods. This includes using automated tools to create accounts or gather information without our explicit permission, even if such actions are carried out while logged into a Wakala Forum account.
- You are prohibited from selling, licensing, or purchasing any account or data obtained from us or our service, regardless of whether such data was collected while logged into a Wakala Forum account. This includes attempting to buy, sell, or transfer any part of your account (such as your username), solicit or collect login credentials or badges from other users, or request or gather Instagram usernames, passwords, or access tokens through unauthorized means.
- You must not post someone else's private or confidential information without their consent, nor engage in any activity that infringes on another person's rights, including intellectual property rights (such as copyright or trademark infringement, or the distribution of counterfeit or pirated goods). You may only use someone else's works in accordance with applicable copyright laws and exceptions. By posting or sharing content, you represent that you either own the content or have obtained the necessary rights and permissions to do so.
- You are not allowed to use a domain name or URL in your username without obtaining our prior written consent.
- You must not engage in, or attempt to engage in, any activity that circumvents, bypasses, or overrides any technological measures designed to control or limit access to the service or its data.
4.3 Permissions You Grant to Us: As part of our agreement, you grant us the necessary permissions to deliver the service effectively.
- We do not claim ownership of any content you post on or through the service, and you are free to share it with others however you choose. However, to operate and provide the service, we require certain legal permissions from you. When you share, post, or upload content covered by intellectual property rights (such as photos or videos) on or in connection with our service, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content—all in accordance with your privacy and application settings. This license remains in effect until you delete your content from our systems. You can remove content individually or delete all of it at once by deleting your account. - By using Wakala Forum, you grant us permission to display your username, profile picture, and information about your interactions—such as likes, follows, and other actions—next to or in connection with accounts, ads, offers, and sponsored content that you engage with on Wakala Solutions Products. This allows us to provide relevant and meaningful ad experiences without any compensation to you. For example, if you like a sponsored post from a brand that has paid to promote its content on Wakala Forum, we may show that interaction to others who have permission to see it. Similarly, if you follow a sponsored account, that follow may be visible to others based on their access to that content. We respect your ad settings, ensuring that your interactions with sponsored content remain within the visibility preferences you have chosen.
- By using Wakala Forum, you agree that we may download and install updates, enhancements, and improvements to the Service on your device. These updates are designed to maintain the security, functionality, and overall performance of Wakala Forum, ensuring that you continue to receive the best possible experience. Updates may include bug fixes, new features, security patches, and performance optimizations, and they may be installed automatically or require your approval, depending on your device settings.
5. Our Reserved Rights
"Our Reserved Rights" refers to the rights that Wakala Forum retains in order to operate, improve, and protect its services. These rights allow Wakala Forum to maintain a safe, functional, and user-friendly environment while adapting to technological advancements and regulatory requirements.
- If you choose a username or similar identifier for your account, we reserve the right to modify it if we determine that a change is necessary or appropriate. This may occur in cases where the selected identifier infringes on someone’s intellectual property, impersonates another individual, or violates our policies.
- If you use content protected by intellectual property rights that we own and provide through our Service—such as images, designs, videos, or sounds made available for you to incorporate into your creations—we retain full ownership and rights over our content. However, this does not affect your ownership of the content you create and share.
- You may only use our intellectual property, trademarks, or any similar marks as explicitly allowed in our Brand Guidelines or with prior written consent from us.
- You must have our written permission or comply with an open-source license to modify, create derivative works, decompile, or attempt to extract our source code.
6. Content Removal and Account Termination
Content Removal and Account Termination refers to our right to remove content that violates our policies and to suspend or delete accounts that breach our terms or pose security risks.
- We may remove any content you share if it violates our Terms of Service, policies (including Community Standards), or if required by law. We can also suspend or terminate your access to the Service if you create risks, violate our policies, or infringe intellectual property rights. If necessary, we may change or terminate the Service to avoid legal or regulatory issues. If you believe your account was terminated in error or wish to delete your account, visit our Help Center. Content deletion begins within 30 days of your request and may take up to 90 days to complete. While this process is ongoing, your content won't be visible but remains subject to our Terms of Use and Privacy Policy. It may take up to 90 days for content to be removed from backups.
- Content may not be deleted within 90 days of account or content deletion in the following cases: if the content has been used by others under this license and they haven't deleted it (in which case the license remains in effect until deletion); if technical limitations prevent deletion within 90 days, in which case we will complete the process as soon as possible; or if deletion would hinder our ability to investigate illegal activity or policy violations, protect the safety and security of our systems and users, comply with legal obligations (such as preserving evidence), or fulfill requests from law enforcement or government agencies. In such cases, the content will be retained only for as long as necessary to serve these purposes, with the retention period varying depending on the situation.
- If you delete or we disable your account, stop using Wakala Forum, or if this agreement is otherwise terminated, these Terms will no longer apply as an agreement between us. However, the sections titled “Your Commitments,” and “Our Agreement and What Happens if We Disagree,” will remain in effect even after your account is deleted, disabled, or the contract is terminated.
7. Our Agreement and Dispute Resolution
Our Agreement and Dispute Resolution outlines the terms governing our relationship and how we handle any disagreements. It specifies the process for resolving disputes, including mediation or arbitration, and clarifies that legal actions will be subject to the laws and jurisdiction specified in the agreement.
7.1 Our Agreement: Your use of features and resources available on the Service is also governed by our Feature and Resource Guidelines. If you choose to use specific features or related services, additional terms will be provided and will form part of our agreement. For instance, if you use payment features, you will be required to accept the Community Payment Terms. If you use Avatars, the Avatar Terms will apply. Similarly, if you use our AI products and features, their specific terms will apply. In the event of any conflict between these terms and this agreement, the additional terms will take precedence.
7.2 Who Is Entitled to Rights Under This Agreement: This agreement does not grant rights to any third parties, and you may not transfer your rights or obligations under it without our consent. However, we reserve the right to assign our rights and obligations to others, such as in the event of a merger, acquisition, sale of assets, or as required by law.
7.3 Liability and Responsibility: Liability and Responsibility outlines the circumstances under which either party may be held accountable for any issues arising from the use of the Service. It clarifies the limits of responsibility, ensuring that Wakala Forum is not liable for certain damages or losses, and defines the user’s role in complying with the terms to avoid harm or infringement.
- Our Service is provided "as is," and we cannot guarantee its safety, security, or flawless operation at all times. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- We do not control the actions or statements of individuals or third parties, and we are not responsible for their conduct (whether online or offline) or content, including any unlawful or objectionable material. Additionally, we are not liable for services or features provided by other individuals or companies, even if accessed through our Service.
- Our liability for any issues arising from the Service is limited to the maximum extent permitted by law. Given the unpredictability of potential impacts, we cannot be held responsible for any loss of profits, revenue, information, or data, or for any consequential, special, indirect, exemplary, punitive, or incidental damages related to these Terms, even if we were aware such damages were possible. This also applies to situations involving the deletion of your content, information, or account.
7.4 How We Resolve Disputes: If you are a consumer, the laws of your country of residence will govern any claim, cause of action, or dispute related to these Terms ("claim"), and you may bring your claim in a court with jurisdiction in that country. However, Lastborn Company Limited reserves the right to bring any claim against you, particularly regarding unauthorized use or abuse of our products, in the court located in your country that has jurisdiction over the matter.
7.5 Unsolicited Submissions: We value your feedback and suggestions, and by providing them, you agree that we may use them without any restrictions or obligation to compensate you. Additionally, we are not required to maintain confidentiality regarding any feedback you provide.
8. Revising These Terms
We may update our Service and policies, and as a result, we may need to revise these Terms to accurately reflect the changes. Unless required by law, we will notify you (for instance, via our Service) prior to making any changes and provide you with an opportunity to review the updated Terms before they take effect. If you continue using or accessing the Service after the updates are applied, you agree to be bound by the revised Terms. If you do not agree with the updated Terms or wish to terminate your agreement, you can delete your account here and cease using any part of the Service.
